Got in an accident involving a City Recycling truck…..?

My friend and I were on the way to her friend’s house in my car. I allowed her to drive. When we got in the neighborhood, there was a recycling truck. I looked down doing something, when I looked back up the truck was backing. My friend got scarred and froze up. Of course we got crunched ( blessed to be alive!). There were witnesses, but they didn’t really hurt or help. The city of charlotte is going to deny my claim becuase they say my friend had time to back up. Even still, we were not in motion, and my friend still has her car, I’m the one stuck without one. I was trying find out what the protocol was for a city vehicle in a residential area. I also don’t remember hearing beeping from the truck. Furthermore, my insurance adjustor said that I assume the risk when I let her drive. She also said that in NC, if the driver of the vehicle is even 1% at fault, that the city can deny the claim. I don’t know. I thought about a lawyer, but was trying to be pro-active on my own part. Any thoughts or advice?

You’re in a tough situation! You really need to fight this out. If your friend was not a licensed driver, or if she was really at fault for the accident then you’re not gonna win. If, however, things happened as stated, then you need to immediately contact legal counsel for a consultation. Until you can speak with an attorney do not have further contact with the city. Stand your ground and go down swinging!
